CELAHKOTANEWS.COM||PEKANBARU – Wakil Kepala Kepolisian Resor (Wakapolres) Siak, Kompol Indra Andiarta dan Kepala Unit I Satuan Reserse, Iptu Aris Gunadi, dilaporkan ke Mabes Polri. Mereka dinilai telah menyalahi prosedur pemeriksaan terhadap Abdul Rahim atas dugaan kasus penggelapan 143 ekor sapi.
Laporan disampaikan Advokat Aswin E Siregar SH MH dan Partner selaku kuasa hukum Abdul Rahim ke Divisi Profesi dan Pengamanan Polri, Jumat (30/9). Laporan tersebut diterima Paur Subbagmoney, Kompol Ervin Isdianto.
Selain Mabes, laporan juga disampaikan ke Komisi Polisi Nasional (Kompolnas). “Kami melihat ada kejanggalan dalam. proses penyidikan. Memperlakukan saksi sebagai tersangka,” ujar Aswin Siregar, didampingi keluarga Abdul Rahim kepada wartawan, Sabtu (1/10).
Aswin menjelaskan, kasus berawal dari laporan dugaan penggelapan 143 ekor sapi oleh Direktur CV Rajawali Transport, Andry Saputra alias Midun ke Polres Siak. “Terlapornya Abdul Rahim,” kata Aswin.
Selanjutnya datang panggilan untuk Abdul Rahim sebagai saksi. Namun dia tidak memenuhi panggilan tersebut dengan surat keterangan tidak bisa hadir karena sakit.
“Kamis tanggal 15 September 2016, klien kita dibawa dari rumahnya sekitar pukul 10.00 WIB pagi ke Siak. Pemeriksaan sebagai saksi sekitar pukul 14.00 WIB,” jelas Aswin.
Pemeriksaan tersebut berlangsung sampai pukul 22.00 WIB. Setelah itu, Abdul Rahim disodorkan berita acara sumpah yang sudah ditangani. Artinya, dengan adanya surat pernyataan sumpah tersebut, Abdul Rahim berpotensi sebagai saksi.
“Selanjutnya, Iptu Aris Gunadi selaku Kepala Unit I Satuan Reserse Kriminal Polres Siak memberitahu klien kami tak boleh pulang dan diamankan selama 1×24 jam di Polres Siak. Kita tanya kenapa, dia jawab itu hak polisi,” jelas Aswin.
Kesokan harinya, Jumat (16/9), Abdul Rahim diberi Surat Perintah Penangkapan (Sprinkap) dengan Nomor; Sp.Kap/81/IX/2016/RESKRIM yang diluarkan tanggal 15 September 2016 dan Surat Peirntah Penahanan Nomor; SP. Han/87/IX/2016/RESKRIM tertanggal 16 Sepetember 2016. Surat itu ditandatangani tim kuasa hukun di buku ekspedisi Polres Siak.
“Artinya, dari pukul 22.00 WIB sampai 16.00 WIB, masih saksi tapi dalam sprinkap dan sprinhan disebutkan surat berlaku tanggal 15 September 2016.. Terjadi pengekangan kebebasan terhadap klien kami mulai dari Kamis pukul 22.00 WIB sampai Jumat pukul 16.00 WIB. Padahal dia masih berstatus saksi,” tutur Aswin.
Tindakan itu jelas melanggar Pasal 1 angka 20 KUHAP yang menyebutkan penangkapan adalah tindakan penyidik berupa pengekangan sementara waktu kebebasan tersangka atau terdakwa apabila terdapat cukup bukti. “Jadi, Aris Gunadi diduga kuat telah memperlakukan klien kami (saksi) sebagai tersangka. Selama itu Mereka di ruang penyidik sedangkan kanit pergi ke Pekanbaru tanpa ada perintah apapun,” ungkapnya.
Kejanggalan lain adalah Sprinkap dan Sprinhan tersebut ditandatangani oleh Wakapolres Siak, Kompol Indra Andiarta. Padahal saat itu ada Pelaksana Tugas (Plt) Kepasa Satuan Reserse Kriminal. Di surat itu, Wakapolres disebutkan selaku penyidik.
“Berdasarkan Perkap Tahun 2012 tentang menajemen penyidikan tidak ada kewenangan wakapolres menandatangani Sprinkap, Pasal 79 huruf c, Atas kejanggalan itu ita buat laporan ke Mabes Polri dan Kampolnas,” paparnya.
Dalam waktu dekat, kasus ini juga direncanakan bakal dilaporkan ke Komisi Nasional (Komnas) Hak Azasi Manusia (HAM). Tindakan mereka diduga melanggar pasal 28 I ayat (1) UUD RI Tahun 1945 dan ketentuan Pasal 1 angka 6 UU RI No 39 Tahun 1999 tentang UU HAM.
“Klien sudah tiga kali diperiksa sebagai tersangka, dan dia tetap mengatakan sakit. Kita pernah minta pembantaran oleh keluarga tapi tdak ada jawaban sampai saat ini,” kata Aswin.
Kasus ini, ungkap Aswin, juga terkait dengan oknum anggota DPR RI Dapil Riau 1. Muhammad Nasir. Dia disebut sebagai pemilik sapi yang menumpangkan ke Abdul Rahim pada tahun 2014.
Pertemuan Abdul Rahim dengan Nasir terjadi di peternakan sapi milik Nasir di Jalan Garuda Saksi. “Di sana Nasir menumpangkan sapi ke klien saya dengan catatan banyak yang mati karena dipatok ular dan jatuh ke kanal,” ucapnya..
Saat itu, Abdul Rahim menyanggupi dengan syarat sapi yang ditumpangkan tidak sampai 50 ekor. Mengingat Abdul Rahim dan Nasir masih punya hubungan keluarga, penitipan itu tidak dilengkapi dengan bukti penerimaan.
Tiba-tiba, Abdul Rahim dituduh menggelapkan sapi milik PT Rajawali Transpor sebanyak 143 ekor. Perusahaan itu, disinyalir milik Nasir.
“Istri Abdul Rahim dan Nasir, kakak adik kandung. Ini memperkuat kepercayaan adanya BAP. Apa kekayaan (sapi, red) ini sudah dilaporkan (Nasir, red) ke KPK,” pungkas Aswin
Sementara itu, Andi Akmal selaku anak Abdul Rahim menilai ada dugaan pemerasaan yang dilakukan Nasir terhadap keluarganya. Pasalnya ada permintaan uang Rp4 miliar agar Abdul Rahim bisa bebas dari tahanan.
Selain itu, dia menilai ada kongkalingking anak Nasir dengan oknun polisi di Siak. Menurutnya, anak Nasir pernah datang ke sel tahanan untuk bertemu Abdul Rahim pada pukul 12.00 malam.
Sesuai Prosedur
Wakapolres Sial, Kompol Indra Andiarta, menegaskan, penyidikan terhadap kasus Abdul Rahim sesuai prosedur. Dia juga mempersilahkan pihak Abdul Rahim melaporkannya ke Mabes Polri dan Kompolnas.
“Tidak apa-apa (dilaporkan, red), itu hak mereka melapor ke mana saja, Silahkan saja. Kita sudah sesuai prosedur. Kalau ada yang menilai di luar prosedur silahkan praperadilankan,” tegas Indra.
Menurut Indra, penyidik melakukan pengamanan terhadap Abdul Rahim dalam rangka proses penyidikan. “Kita tidak menahan tapi meminta keterangan selama 1×24 jam. Setelah itu baru ditahan dengan Sprinhan,” ucapnya.
Indra membenarkan kalau dirinya yang menandatangani Sprinkap dan Sprinhan terhadap Abdul Rahim. Pasalnya saat itu jabatan Kasat Reskrim kosong dan Kapolres tidak ada di tempat. “Jadi harus ditandatangani, tidak boleh kosong saja,” tanbahnya,
Indra membenarkan adanya keberadaan Plt Kasat Reskrim Polres Kampar. Namun, bersangkutan belum beleh menandatangani Sprinkap dan Sprinhan karena belum menyandang gelar pendidikan sarjana.
“Syarat penyidik itu harus sarjana, minimal S1 (Strata Satu. Itu sudah ada aturannya. Siapa saja yang boleh menandatangani,” ucapnya.
Indra juga membantah adanya kongkalingkong dalam penanganan kasus ini. Menurutnya kedatangan anak Nasir ke Polres Siak juga dalam proses penyidikam karena dia dimintai keterangan sebagai saksi.
“Saat itu penyidik meminta keterangannya sebagai saksi karena dia yang mempertemukan.. Sebelumnya sudah beberapa kali dipanggil tapi bersangkutan ada di Medan. Untuk itu, penyidik bon tersangka (Abdul Rahim, red) dari tahanan. Itu pun bukan jam 12 malam tapi jam 8,” pungkasnya.(rt/net)
